Fagan Assists in Drafting Amendments to Wrongful Discharge Act and Getting Bill Signed into Law
Gerry Fagan successfully helped to draft amendments to Montana’s Wrongful Discharge from Employment Act and to get the amendments passed by the Legislature and signed into law by the Governor. The amendments updated the Act and addressed several areas of the Act that had created some uncertainties or discrepancies, including awardable damages, grounds for wrongful discharges, and the applicable probationary period. Fagan was on an ad hoc group of attorneys who drafted the amendments. He also testified in favor of the bill before both House and Senate committees. The Bill was the first substantive changes to the WDEA since it was passed into law in the 1980s.
